Our general Conditions of Use for B&B Hotels WI-FI service

Clause 1. PURPOSE

The purpose of this document is to define the Conditions of Use for the WI-FI service provided by B&B Hotels.
With the "hotel bb" WI-FI service, users with a PDA or a WI-FI enabled laptop computer can benefit from a wireless internet connection when inside the areas covered by the WI-FI network in B&B hotels (Reception and breakfast room).
The service includes the basic internet access functions. The service does not provide a mailbox and does not include WEB page hosting. The service can be accessed from any laptop computer equipped with a Wireless LAN card in compliance with the IEEE 802.11b standard and certified by the WI-FI Alliance.

B&B Hotels recommends the following PC configuration:

* using Windows XP or windows 2000,
* with built-in WI-FI or with a PCMCIA card in compliance with the IEE 802.11b standard and certified by the WI-FI TM Alliance (information available at www.wi-fi.org)
* with an Internet Explorer (at least version 4.67) or Netscape (at least version 5.5) browser.
 

Clause 2 . ACCESS TO THE SERVICE

In principle the free WI-FI Service available in B&B Hotels can be accessed 24 hours a day, during the opening hours of the areas covered by the service (Reception and breakfast room).
To access the free service, users must provide their mobile telephone number, their surname, their first name and their date of birth in order to create their access code.
As soon as all this information has been provided, a password (access code) will be sent by sms to the telephone number given beforehand.
The next time the user logs in, this telephone number will then be used as his login ID, and the access code received by sms will be used as his password in order to access the "hotel bb" WI-FI area.
 

Clause 3. COMMITMENTS AND RESPONSIBILITIES OF USERS

• 3.1 Service access codes
  The access codes which enable users to log in and connect to the service are personal and confidential.
  Users agree to keep the access codes secret and not disclose them in any way whatsoever.
  By using these access codes, users have individual and exclusive access to the service. It is therefore prohibited to provide it to third parties.
  Any access to the "hotel bb" WI-FI service made using the user's access codes is the full responsibility of the user. as B&B Hotels cannot be held responsible on these grounds..
   

• 3.2 Specific internet related obligations
  
  3.2.1 As it concerns using the internet, the user is informed that the internet is a network which carries data which is likely to be protected by intellectual property, literary, artistic and photographic rights or data likely to infringe the legal terms in force.
  The user is therefore prohibited from transmitting across the internet any prohibited illicit, illegal, immoral or indecent material or any data which may infringe the rights of third parties and intellectual property, literary, artistic or photographic rights in particular.
  
  3.2.2 The user is prohibited from any fraudulent, abusive or excessive use of the service, such as voluntarily or involuntarily jamming mail servers and/or mail recipient servers with mass mailing (spamming, bunk mail, junk mail or mail bombing) or from their network, or due to sending attractive messages which are certain to generate an imposing number of responses (teasing or trolling) which could interrupt the availability of said servers or network.
  
  3.2.3 As it concerns products or services on the internet network, the user must directly inform content providers of any complaint related to the execution of services made by the providers or with regards to the sale of products sold by them.
  
  3.2.4 B&B Hotels warn the user of the diversity of content available on the internet, which may cause harm to minors.
   
• 3.3 Responsibilities of the user
  
  3.3.1 The user is the only person responsible for any direct/indirect or material/immaterial harm caused to third parties due to his own use of the service.
  
  3.3.2 The user is the only person responsible for using his access codes. Any use of the service (transmission of data), carried out using the user's access codes is deemed to have been made by the user himself, unless proven otherwise.
   

Clause 4. SECURITY

• 4.1 The level of coding of the radio channel may vary depending on the user's configuration profile. For some of these profiles, the radio channel is not coded. Communication made via the "hotel bb" WI-FI service has in principle the same level of security as standard internet communication.
  If the user wishes to increase the level of security, he may install security software himself, such as a firewall or a VPN (Virtual Private Network).
  Absolute protection against intrusions or against illicit listening cannot be guaranteed. B&B Hotel cannot be held responsible with regards to such events.
• 4.2 It must be stressed that the internet is not a secure network. In these conditions, the user is responsible for taking all appropriate measures so as to protect his own data and/or software particularly from contamination by viruses which may be circulating around the internet network or from intrusion of his terminal's system (laptop computer) by a third party irrespective of the purpose, and is also responsible for backing up his laptop computer before and after setting up the "hotel bb" WI-FI service.
• 4.3 The user is also fully aware of the reliability of the internet, particularly in terms of the lack of security concerning the transmission of data and the possible unreliability of performance with regards to data transmission volumes and speeds.
  The user is also aware that the integrity, authentication and confidentiality of information, files and data of any nature (credit card code etc.) which he wishes to use on the internet may not be guaranteed on this network.
  Therefore the user must not transmit via the internet network any messages that he wishes to keep fully confidential.

Clause 5. COMMITMENTS AND RESPONSIBILITES OF B&B HOTELS

• 5.1 B&B HOTELS makes use of all the facilities it has available in order to provide the "hotel bb" free WI-FI service.
• 5.2 B&B HOTELS cannot be held responsible for the content accessible via the internet network or the harm it may cause from its use unless this harm was intentionally caused by B&B HOTEL. In consideration of secrecy, which must be in place for private communication,
  B&B HOTELS does not apply any controls on the content or the characteristics of the data received or transmitted by the user on its network and/or on the internet network. However, to ensure that the internet access system is managed correctly,
  B&B HOTELS reserves the right to delete any messages and stop any operation by the user which could interrupt the correct working order of its network or the internet network, or if any operational, legal or ethical rules are not respected.
  An exception may be made to this confidentiality rule within the limits authorized by the law, upon request of the public and/or judicial authorities.
• 5.3 B&B HOTELS cannot be held responsible:
  * If a LAN wireless network card (IEEE 802.11b) is faulty or is not compatible with the "hotel bb" network (especially if it is linked to the settings of the laptop or the Wireless LAN network card, which are different from those set up on the network),
  * If the mail systems or applications set up and/or operated on by third parties are incompatible or faulty. The possibility of sending e-mails by using e-mail software from the "hotel bb" WI-FI network depends on the mail provider chosen by the user, as some providers don't authorize mail that is sent from a network other than their own. It is the responsibility of the user to refer the information related to the configuration of his mail software back to his internet service provider, as B&B HOTEL cannot be held responsible on these grounds.
  * in the event of poor use of the service by the user,
  * in the event of poor installation and/or poor configuration and/or due to a fault in the user's laptop computer or PDA or the Wireless LAN (IEEE 802.11b) network card,
  * if the user has not respected his obligations,
  * if it is impossible to access a company's virtual private network via the internet)
  * in the event of disturbances or interruptions in the "hotel bb" WI-FI network or access,
  * in the event of disturbances and/or full or partial unavailability, and/or interruption of all or part of the services offered on the networks used by third party operators,
  * in the event of 'force majeure' in accordance with the Court of Appeal's case law.
• 5.4 As part of these conditions, B&B HOTELS remains uninvolved in any disputes which may set the user of our services against third parties.
• 5.5 As part of these conditions, B&B HOTELS offers free access to the "hotel bb" WI-FI network and may not under any circumstances be held responsible if the service is interrupted or can not be accessed.

Clause 6. SUSPENSION / TERMINATION

B&B HOTEL reserves the right to suspend and terminate access to the service, without the user being entitled to claim any compensation whatsoever, in the event of a breach in any of the clauses in these conditions relating to the use of the "hotel bb" WI-FI service especially in the following cases:

• * B&B HOTEL is notified by internet users that the user has breached the internet code of good conduct or has used the internet in a way that prejudices the rights of third parties, or which is contrary to public decency or law and order.
• * B&B HOTEL is notified by parties with a legal claim to rights that the user reproduces and/or disseminates data protected by an intellectual property right;
• * B&B HOTEL notes instances of hacking or attempts to make illicit use of the information circulating on the network, and stemming from the user's account.

Clause 7. NON PERSONAL DATA AND PERSONAL INFORMATION

B&B HOTELS may store non personal data such as the type of browser used or the location where the user is connected to the "hotel bb" WI-FI Service.
This information does not in any circumstances enable a link to be established with the user and is only used to inform B&B HOTELS so that it can offer an efficient service for the service's access points.
B&B HOTELS may also on occasions inform owners and operators of web pages linked to the service's pages, and of the number of users who access these Web pages from the Service's pages. This information does not in any circumstances enable a link to be established with the user.
It is possible that as part of using the service, B&B HOTELS may, throughout the duration and for the needs of said service, gather data about the traffic generated by the user, and may subsequently store, retain and process the data about the communication made, which the user accepts.
Secondly, and with regards to the gathering of nominative data by B&B HOTELS, it must take specific measures to ensure that said information that it keeps or processes is protected and kept confidential in accordance with law 78-17 dated 6th January 1978, relating to French Data Protection.
They may give rise to exercising the individual right to access, rectify and delete with B&B HOTELS.
To exercise the right of access, the user must write to: SAS B&B Hôtels - Service Clientèle des hôtels B&B - 271 Rue Général Paulet - 29219 Brest Cedex 2, France.

Clause 8. FORCE MAJEURE

B&B HOTELS cannot be held responsible for not executing all or part of its obligations if said non-execution or partial execution was caused by an event beyond its control, such as 'force majeure' in accordance with the Court of Appeal's case law.
